The “Mediation Development Programme for the Belt and Road (Cambodia, Vietnam and Malaysia)” administered by the Hong Kong Arbitration Society has been successfully completed by the end of August 2021.
Funded by the Professional Services Advancement Support Scheme (“PASS”) of the Commerce and Economic Development Bureau of the Hong Kong Government, the project commenced in 2018. The objectives of the project include promoting the development of Hong Kong mediation in the three “Belt and Road” countries, namely Cambodia, Vietnam and Malaysia, and enhancing the skills and knowledge of the public and the mediators in this regard. The Hong Kong Arbitration Society is very grateful for the supports provided by the Commerce and Economic Development Bureau which enabled the smooth and successful delivery of this project.
The implementation of the project is summarised as follows:
(1) Hong Kong Mediation Practice Manual
The Hong Kong Arbitration Society published the "Hong Kong Mediation Practice Manual" in 2020 to provide the public and mediators with professional and practical knowledge in mediation. About 200 handbooks were issued this time for distribution free of charge at the Hong Kong Arbitration Society and the Joint Mediation Helpline Office. The electronic version of the manual can also be downloaded for free on the website of the Hong Kong Arbitration Society.
(2) Organizing mediation workshops in Hong Kong
The Hong Kong Arbitration Society held a total of three workshops in October 2019, November 2020 and December 2020 for mediators in Hong Kong. The workshops conveyed practical mediation skills, methods and knowledge to deal with disputes related to the Belt and Road, enhancing the competitiveness of Hong Kong mediators. A total of 152 mediators participated in the three workshops.
(3) Organizing seminars and exchange meetings in Cambodia, Vietnam and Malaysia
The Hong Kong Arbitration Society sent a delegation to Cambodia for promotion, meeting and exchanges with Cambodia’s National Commercial Arbitration Centre and the Cambodia International Chamber of Commerce during the period from 6th to 8th November, 2019, and held a seminar for promotion of Hong Kong’s dispute resolution services. There were 80 people participated in the seminar. The delegates to Cambodia gained valuable understanding of the local business environment and the development of dispute resolution services there, and at the same time promoted Hong Kong's dispute resolution services.
In addition, in view of the impacts of the COVID-19 pandemic, special arrangements were made and the exchanges and promotion activities in Vietnam and Malaysia were held online.
In June 2021, the Hong Kong Arbitration Society held online meetings and exchanges with the Vietnam Mediation Centre and the Business Association of China in Vietnam, and reached a preliminary consensus with the Vietnam Mediation Centre to carry out a plan for the exchange of experiences between mediators in Hong Kong and Vietnam. Also, the seminars organised by the Hong Kong Arbitration Society specifically for the local businesses in Vietnam to promote Hong Kong's dispute resolution services have attracted more than 150 participants.
Malaysia’s online exchange activities were also successfully completed at the end of August 2021 The Hong Kong Arbitration Society met and exchanged with the Asia International Arbitration Centre (Malaysia) and the Malaysian Small and Medium Enterprises Association respectively, and reached a preliminary consensus with the Asia International Arbitration Centre (Malaysia) to carry out a plan for the mentorship program between mediators in Hong Kong and Malaysia. The Hong Kong Arbitration Society also organized seminars introducing Hong Kong's dispute resolution services for Malaysian businesses, with more than 100 people participated.
The project implemented this time has conveyed a deeper knowledge and understanding of Hong Kong’s dispute resolution services in the three countries of Cambodia, Vietnam and Malaysia along the “Belt and Road”. In particular, the project has attained the following achievements:
