Since 2009, the Department of Justice has been promoting “Mediate First”, and set up an Advisory
Committee to promote arbitration in Hong Kong in 2014.
The Hong Kong Arbitration Society upholds and actively promotes “Mediation First, Arbitration Next”,
and aims to promote the resolution of disputes through a form of arbitration which is more efficient,
cost-effective and affordable than litigation and traditional arbitration. With this objective, the
HKAS has developed the HKAS Rules which govern the conduct of efficient arbitration.
Many enterprises have already incorporated “Mediation First, Arbitration Next” clauses into their
contracts, thus enhancing their images of corporate social responsibility and raising the confidence
of their clients and business partners, thereby creating a positive impact on the business
environment.
In the future, we hope that the society and businesses will gain a deeper understanding about
mediation and efficient arbitration and that an increasing number of small and medium enterprises will
be willing to adopt the concept of “Mediation First, Arbitration Next”, such that this new culture of
resolving disputes through mediation and efficient arbitration can become more widespread and continue
to develop in Hong Kong.
